RACE FUEL: A NASCARD DRINKING GAME by weekend shift, llc WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

IMPORTANT – PLEASE READ CAREFULLY BEFORE USE

By purchasing, opening, or using Race Fuel: A NASCARD Drinking Game (“the Product”), manufactured by Weekend Shift LLC (“the Company”), you acknowledge and agree to the following terms.

1. Entertainment Purposes Only

  • This Product is a card game intended solely for entertainment.

  • The game does not require alcohol. Players may use water, soda, juice, or other non-alcoholic beverages.

  • If alcohol is chosen, players must follow all applicable laws.

2. Legal Drinking Age

  • Alcohol consumption is only for individuals 21 years of age or older in the United States, or the legal drinking age in their jurisdiction.

  • The Product does not supply alcohol. Players are responsible for obtaining and consuming beverages in compliance with all local, state, and federal laws.

  • Do not provide alcohol to anyone under the legal drinking age or to anyone who is visibly intoxicated.

3. Responsible Use

  • Please drink responsibly.

  • Never drink and drive or operate a vehicle, machinery, or engage in unsafe activities while consuming alcohol.

  • If you are pregnant, nursing, taking medication, or have a medical condition, consult a doctor before consuming alcohol.

  • Consider non-alcoholic alternatives while playing.

4. Assumption of Risk

You acknowledge that participating in activities involving alcohol carries inherent risks, including intoxication, personal injury, illness, property damage, and even death. You voluntarily assume all such risks, whether known or unknown, associated with participating in activities while using this Product.

5. Waiver and Release of Liability

To the fullest extent permitted by law, you, your heirs, and assigns hereby release, waive, and discharge Weekend Shift LLC, its members, managers, officers, employees, contractors, agents, distributors, and affiliates (“Releasees”) from any and all claims, demands, damages, losses, liabilities, or expenses (including attorneys’ fees) arising out of or relating to your purchase, possession, or use of the Product.

  • This waiver includes claims arising from ordinary negligence but does not extend to gross negligence, reckless, or intentional misconduct, or any liability that cannot be waived under applicable law.

6. Indemnification

You agree to indemnify and hold harmless the Releasees from and against any claims, damages, liabilities, or expenses (including attorneys’ fees) brought by you or others in connection with your use of this Product, except to the extent caused by the gross negligence or willful misconduct of the Releasees.

7. Miscellaneous

  • This waiver may not be modified except in writing by the Company.

  • If any part of this agreement is found unenforceable, the remainder shall remain in effect.

  • This agreement is intended to be as broad and inclusive as permitted by applicable law.

8. Acknowledgement

By purchasing, opening, or using this Product, you acknowledge that you have read this agreement, understand its terms, and voluntarily accept its conditions. You understand that you are waiving certain legal rights and accept full responsibility for your participation.
